CFTC Releases Two Key FTX Witnesses Without Civil Penalties - But $11 Billion Forfeiture Bill Still Awaits

The U.S. Commodity Futures Trading Commission (CFTC) has officially closed its civil case against two former key executives of the FTX crypto exchange. On August 19, a U.S. federal court granted supplemental consent orders for former Alameda Research CEO Caroline Ellison and Alameda and FTX co-founder Gary Wang. Both received market activity bans - but escaped without a single penny of civil penalties from the commodity regulator.

According to the details of the ruling, Ellison is barred from trading activities for 5 full years and her right to register with the CFTC has been revoked for 10 years. Wang received a trading ban of a similar duration, along with an 8-year registration suspension. The duration of these penalties is notably not calculated starting from the date the latest verdict was handed down. The court ruled that the ban period is backdated to December 23, 2022, coinciding with the issuance of the initial consent order.

The Price of a Swift Confession

Ellison and Wang’s escape from restitution, disgorgement, and civil penalties did not happen out of the blue. The CFTC stated that this leniency was a direct reward for their early contributions to the investigation and their consistent level of cooperation throughout the series of legal proceedings.

According to investigators’ records, Wang had a distinct role. He was recorded as the first person from Sam Bankman-Fried’s (SBF) inner circle to proactively approach U.S. law enforcement in 2022. Both later agreed to plead guilty to charges of commodity fraud conspiracy in December 2022. Their early actions and courtroom testimony provided critical ammunition that ultimately sent SBF to prison with a 25-year sentence in March 2024.

One Debt Cancelled, a Billion-Dollar Bill Still Awaits

Zero fines from the CFTC does not mean they walk away without financial burdens. The Commission dropped these civil charges precisely because it considered the severity of the financial consequences they had already faced in the criminal case. Both are now bound by an $11.02 billion forfeiture order, a financial burden they must pay on a joint-and-several basis.

The matter of prison sentences for the two figures has also been resolved by a federal judge. Ellison went behind bars after being sentenced to 2 years in prison in September 2024. Meanwhile, Wang avoided additional prison time after the judge sentenced him to time served and 3 years of supervised release in November 2024.

The wave of FTX case settlements does not stop at the level of former executive leaders. In May 2026, law firm Fenwick & West agreed to pay a $54 million settlement to end a civil class-action lawsuit regarding their role. For Ellison and Wang, today’s CFTC ruling removes one file from their long list of legal troubles, but the eleven-billion-dollar bill ensures that the rest of their lives will never be free from the shadow of FTX.
