SEC to Vote on Permanent Crypto Rules August 14 - Taking Control After Senate Fails to Pass Bill

The United States Securities and Exchange Commission (SEC) has scheduled a meeting on August 14, 2026, to initiate a vote on the first formal crypto rules under the leadership of Chairman Paul Atkins. The meeting announcement was released on Monday evening with short notice. Although this agenda was previously on the agency’s calendar, the new schedule has shifted the market’s focus.

The proposal is named Regulation Crypto. Its main focus is the establishment of a special offering regime for certain investment contracts. This draft is projected to open a legal path for crypto companies to raise capital without triggering full SEC registration requirements. The rule also prepares a legal exit route for developers when they are no longer actively involved in the management of a crypto project.

This August vote marks the first time the SEC has initiated the drafting of binding crypto rules. Until now, the agency’s guidance has only taken the form of staff policy statements. Such documents are easily modified or rescinded at any time, making them unreliable as a long-term foundation for industry players.

Swift Maneuvers After Legislative Deadlock

The announcement schedule for Regulation Crypto coincides with a deadlock in the legislative arena. The SEC released its meeting schedule right after the United States Senate failed to initiate a vote on the CLARITY Act ahead of the August recess.

TD Cowen analyst Jaret Seiberg views the SEC’s move as a response to the stalled bill. “This is the first step of several rulemakings the SEC will take to provide regulatory certainty for crypto assets after the Senate failed,” Seiberg said, commenting on the situation.

On the other hand, political negotiations regarding crypto legislation have not stopped completely. White House representative Patrick Witt stated that his party is still negotiating the CLARITY Act with the Democrats to target the next voting schedule in September.

Waiting Another Two to Three Months

Although the Regulation Crypto vote is just days away, certainty for the industry remains far off. The bureaucratic stage of rulemaking takes a long time. After August 14, the SEC is required to open a public comment period for two to three months. Following that period, the draft revision stages will take several more months before the rule officially takes effect.

Along with this document, the SEC is also working on two parallel tasks related to digital assets. They are drafting a joint taxonomy with the Commodity Futures Trading Commission (CFTC) to standardize the classification of crypto assets. They are also preparing a new approach to regulate tokenized securities.

For crypto companies that have been waiting for years for a legal boundary, Regulation Crypto at least provides an initial glimpse of the policy direction. As legislative debates stall, regulatory control shifts back to the executive agency.
