Hester Peirce, a Securities and Exchange Commission (SEC) commissioner widely known as “Crypto Mom”, is stepping down from her post on Friday, October 3, 2026. Peirce is ending her tenure roughly two months ahead of the expiration of her 18-month extension. Her departure leaves a thin leadership structure to oversee the $3 trillion crypto industry.
Peirce’s move marks a rare historical moment. The SEC must now operate relying solely on Chairman Paul Atkins and Commissioner Mark Uyeda, both Republicans. Historical records indicate this is only the second time in US history that the regulatory agency has operated with just two commissioners.
Vacant Seats Across Two Major Regulators
The Commodity Futures Trading Commission (CFTC) was already operating shorthanded. Chairman Michael Selig has served as the sole commissioner since Caroline Pham stepped down in December 2025. A total of seven commissioner seats will sit vacant across the SEC and CFTC after Peirce leaves her post this Friday.
Federal law dictates that only President Trump has the authority to nominate replacement commissioners. So far, the White House has yet to announce a slate of nominees. An administration official merely stated that the President intends to put forward new members for both agencies in the near future.
Efforts to fill seats at the CFTC appear slightly clearer. A CNBC report on September 4 revealed that White House staff are vetting four potential candidates to take the vacant seats there.
Oversight Continues Through Internal Rulemaking
The three remaining leaders bear the task of charting the regulatory direction. The Clarity Act recently collapsed in the Senate following a narrow 49-50 vote. The failure has forced the SEC and CFTC to proceed with crypto oversight through the rulemaking process.
Both agencies continue regulating the market using their internal authorities. The SEC issued guidance on investment contract criteria, while the CFTC stepped in to regulate recordkeeping using blockchain technology. Crafting detailed rules for a trillion-dollar industry now rests entirely on the decisions of the three figures who remain at the helm of both agencies.
