Fake Regulators Using ESMA Logo Target Millions of European Crypto Users - Here is Their Full Modus Operandi

More than a thousand crypto platforms in Europe are now operating without a valid license. The transition or grandfathering period for the Markets in Crypto-Assets (MiCA) regulation officially ended on July 1, 2026. As a result, all unauthorized virtual asset service providers must immediately cease operations in the European Economic Area (EEA). This rule offers no leeway: they must shut down services and direct customers to transfer their assets to licensed platforms.

Data from TRM Labs captures the scale of this migration. As of July 1, 2026, they identified 1,343 active crypto service providers in the EEA region. Out of that number, only 281 entities have secured a MiCA license, while the remaining 1,062 fall into the unlicensed category. Many media outlets are starting to estimate that around 10 million European crypto users are forced to find a new home for their assets due to this forced exodus, although the European Securities and Markets Authority (ESMA) has not yet released official figures.

Fund Recovery Scams Armed with Official Logos

Mass panic and the large number of users who must transfer their assets in a short time have created a loophole for criminals. Financial authorities from various European countries - ranging from the AMF in France, the AFM in the Netherlands, to the FMA in Austria - have simultaneously reported the emergence of a new scam method. This time, the fraudsters are not targeting victims’ wallets through technical hacks, but are instead posing as official regulators offering assistance.

To carry out their actions, this group of scammers designs convincing fake identities. They use institution names, copy the ESMA logo, and print counterfeit documents to establish a legitimate impression in the eyes of victims. The perpetrators have even built clone websites that look identical to the European regulatory portal. While victims are confused about how to transfer assets from the closed platforms, the scammers step in to offer fund recovery services. The end of this scheme is always the same: victims are required to transfer a sum of money as an upfront administrative fee before they are promised their assets will be returned.

How to Verify Amid the Confusion

Responding to the widespread attacks using their name, ESMA reacted immediately. The top regulatory body emphasized one strict rule: they will never contact users. ESMA assures that none of its representatives will ask for customers’ personal information, let alone charge administrative fees to secure or recover trapped crypto assets.

So how can users distinguish truly licensed platforms? The last and only line of defense at this time is the official MiCA register managed directly on the ESMA website. This portal serves as the single authorized source for the public to verify the legal status of a crypto exchange. While some third-party tracking tools are scheduled to launch in August 2026, these independent tools do not carry legal weight as a final reference.

For crypto owners forced out of their old platforms, the situation is indeed urgent. However, moving funds to the wrong exchange risks losing those assets forever. Ignore any messages claiming to be from the government, and manually check the destination exchange’s license on the regulator’s portal. The moment there is a request for an upfront recovery fee, that is where the scam begins.
