Clarity Act Heads to Senate Floor as Permanent Crypto Ban on Officials Dropped

Coinbase CEO Brian Armstrong stated that the Clarity Act is now ready for a full Senate floor vote. The news spread rapidly on X with 5,795 likes, marking a new chapter for digital asset regulation after previous impasses.

The previous stalemate centered on a ban barring government officials from holding crypto assets. The ethics dispute weighed on market optimism, driving the Clarity Act’s odds of passing down to 39% on prediction market Polymarket. The bill’s final draft resolved the issue through a compromise. Thanks to concessions from Trump, the ownership ban originally designed to be permanent was shifted to a temporary measure - a critical change that enables more senators to lend their support.

Money Flows to Pro-Crypto Camp

Support for advancing the legislation through Congress comes alongside massive political capital. Fairshake PAC and its affiliates have raised a $191 million war chest to influence various elections across the United States. This funding machine is already at work at the state level, targeting politicians receptive to crypto innovation.

In Michigan, affiliate Protect Progress deployed $986,000 during the primary election to protect the seat of Representative Shri Thanedar. The candidate has a track record aligned with the industry, having voted in favor of the Clarity Act, the GENIUS Act, and the Promoting Innovation in Blockchain Development Act in the House. A similar strategy unfolded in Arizona, where Crypto PAC poured more than $100,000 into Representative Greg Stanton’s campaign. Stanton won his primary with 65% of the vote.

60 Votes Needed for Federal Framework

The bill’s ultimate objective is to establish a federal market framework for all digital assets. If enacted, the legislation will govern the operations of crypto exchanges, technical guidelines for system developers, and standards for token issuers operating in the United States.

Despite heading to the Senate, the remaining path is not entirely obstacle-free. Passing the Clarity Act requires a 60-vote threshold. Senators must still navigate floor debate, alongside the potential emergence of further amendments that could modify the final draft.

For market participants, the Senate showdown carries direct consequences for price action. A Grayscale report in June cited the passage of the Clarity Act as one of three indispensable conditions for Bitcoin to print a cycle bottom. With lobbying underway, the industry is now betting that the ethics compromise can secure the 60 decisive votes.
