Coinbase expects a Senate vote on the Clarity Act bill could take place as early as Monday, August 3, 2026. Designed to establish a federal market structure for digital assets and clarify the division of authority between the SEC and CFTC, the legislation continues to build last-minute momentum. Franklin Templeton also voiced public support, stating that passing the bill would deliver the regulatory clarity long sought by the US crypto industry.
However, the path to final passage remains hindered by congressional math.
The 60-Vote Wall
Republicans currently hold 53 Senate seats. Senate rules require them to secure at least 60 votes to overcome the cloture threshold before bringing the bill to a final vote. This seven-vote deficit ensures the bill’s fate rests entirely on securing Democratic support.
At least seven Democratic senators have stated that the latest draft of the Clarity Act falls short of their expectations, particularly regarding ethics rules, consumer protection, and Decentralized Finance (DeFi) oversight. Senators Cortez Masto and Warner are even withholding their support until stronger provisions to combat financial crime in the crypto space are included.
Compromise efforts are currently being spearheaded by Senator Tillis, who is leading bipartisan negotiations to draft stricter ethics rules. However, cracks have also appeared within Republican ranks, as Senators Hawley and Paul continue to withhold confirmation of their final stances.
Racing Against the Recess Deadline
The Senate’s August 7 recess deadline leaves less than a week for deliberations. Facing a tight schedule, Senate leaders are discussing emergency options to keep lawmakers working for several extra days to secure time for a vote.
The draft revision process has also yielded diplomatic breakthroughs outside the Senate. The National Fraternal Order of Police swung its support behind the Clarity Act after lawmakers addressed several of their concerns regarding BRCA regulations. Amid the intensifying lobbying, a separate warning was issued by SEC Commissioner Hester Peirce, who highlighted the potential treatment of crypto vaults as securities.
For crypto market participants, the coming week will be decisive. Any agreement reached over the next five days will determine whether the industry secures a new regulatory roadmap or faces disappointment and a prolonged wait until senators return from recess.
