Clarity Act Gagal Raih 60 Suara Senat AS - Bos Pengelola $3,5 Triliun Peringatkan Bisnis Kripto Pindah ke Asia

Clarity Act Fails to Secure 60 US Senate Votes - Head of $3.5T Asset Manager Warns Crypto Business Moving to Asia

The US Senate’s failure to pass federal crypto legislation has far-reaching consequences for the global digital asset competitive landscape. Peter Hughes, CEO and founder of Apex Group, which administers over $3.5 trillion in assets across 50 jurisdictions, warned that the deadlock in Washington will drive digital asset businesses toward Asia and the Middle East.

The Clarity Act bill failed to pass in the US Senate in September 2026 after falling short of the required 60 votes. The legislation was designed to establish clearer federal rules for digital assets while dividing market oversight authority between the US Securities and Exchange Commission (SEC) and the Commodity Futures Trading Commission (CFTC). However, the agreement stalled over disputes regarding ethics clauses, stablecoin yields, and regulatory concerns.

Behind the regulatory debate, Hughes highlighted the role of the conventional US banking industry. US banks were seen as influencing the direction of debates surrounding both the Clarity Act and the GENIUS Act in an effort to protect their positions within the financial system.

As federal discussions stalled, the competitive regulatory landscape shifted to other regions.

Jurisdictional Race Outside Washington

In response to the Clarity Act’s failure, the SEC and CFTC moved swiftly to propose their own versions of regulations. However, Hughes argued that actions by US or European Union regulators would not automatically win the global competition for capital. Although the EU’s MiCA framework has been in effect since July 1, 2026, Hughes noted that the regulation is slow to evolve and overly restrictive.

Instead, Hughes sees greater opportunities opening up across Asia, the Middle East, and even Bermuda. These jurisdictions have moved rapidly to build legal regimes tailored specifically for future financial products.

Real Opportunities from Asset Tokenization

According to Hughes, one of the biggest drivers of institutional adoption is tokenized money market funds. The comparison is immediately apparent in the yield gap: blockchain-based money market instruments offer yields of 5%, whereas bank deposits only provide yields around 3%.

Apex Group has begun executing this business direction outside the US. The firm recently partnered with droppRWA and Tokeny to convert real-world assets (RWA) into legally regulated, blockchain-based investment products, starting in Saudi Arabia.

Opportunities in Saudi Arabia opened up after local authorities revised property regulations. droppRWA CEO Faisal Monai stated that Saudi Arabia introduced regulatory adjustments that enable real estate tokenization while opening the door to broader foreign investor participation.

For capital market participants, the difference in regulatory speed determines where capital flows. As the US Congress struggles to agree on a federal oversight mandate, digital product development is shifting toward jurisdictions that have already established legal certainty.
