Democrats Reach 94% Odds on Prediction Markets - Crypto Bill Opponents Win Reelection to Congress

Political betting markets shifted rapidly as polls began to close. Data from Kalshi and Polymarket showed Democratic odds of controlling the US Senate surging to 93%-94%, after briefly touching 99%. At the same time, the probability of Democrats holding the House of Representatives stood between 98%-99%. Early vote counts in the 2026 US midterm elections will determine the balance of power in Congress for the remaining two years of President Donald Trump’s term - a shift that immediately clouds the future of crypto regulation.

Crypto-backed Republican candidate Andy Barr secured a Senate seat in Kentucky. However, in Georgia, incumbent Democratic Senator Jon Ossoff retained his seat after defeating Republican challenger Mike Collins.

Regulatory Critics Secure Seats

Industry concerns center on the return of lawmakers who have consistently opposed pro-crypto regulatory initiatives. Two Democratic senators frequently critical of the digital asset sector, Ed Markey and Chris Coons, won reelection in Massachusetts and Delaware, respectively. Markey has been an opponent of the GENIUS stablecoin bill, while Coons has vocally criticized Donald Trump’s involvement in memecoin launches.

Debbie Wasserman Schultz of Florida’s 20th congressional district and Mark Warner of Virginia also won their respective races. Both have opposed advancing the CLARITY Act crypto market structure bill, legislation designed to clarify federal regulatory jurisdiction over digital assets.

The victories for regulatory opponents come despite extensive mobilization efforts by industry advocacy groups. Stand With Crypto had previously published 45 bipartisan candidate endorsements and claimed to mobilize a network of 3.1 million advocates in this election. Despite voter mobilization, the newly formed Congress once again includes figures who oppose the crypto legislative agenda.

Where Crypto Policy Heads Next

With Congress increasingly unlikely to pass new legislation, the regulatory focus shifts to executive agencies. 1inch Deputy General Counsel Maylea Ma projected that US crypto policy in the coming years will be driven more by regulatory agencies such as the SEC, CFTC, and the Treasury Department rather than new congressional statutes.

The lack of statutory backing is seen as holding back broader adoption. D3 co-founder Michael Ho warned that the absence of legislation keeps large-scale institutional capital on the sidelines. According to Ho, agency rules or guidance carry a fundamental flaw: they are vulnerable to being reversed whenever a new administration takes office.

For crypto market participants, these midterm results underscore legal hurdles: momentum to pass the CLARITY Act faces growing resistance, leaving the industry forced to navigate agency regulations that can shift at any time.
