The odds of federal crypto regulation legislation passing in 2026 have dropped by 48% to just 17% on the Polymarket prediction market. This decline follows Senator Elizabeth Warren’s official rejection of the CLARITY Act draft in its current form. On the Senate floor, Majority Leader John Thune also failed to schedule a cloture vote for the crypto legislation before the August recess. Instead, he prioritized two other agendas: the Protect College Sports Act and the nomination of Todd Blanche as Attorney General.
Warren in principle still supports the existence of federal crypto regulation. However, she highlighted four key loopholes in the current draft: protection from political corruption, consumer protection, national security, and financial stability. This sharp focus on political corruption aligns with Warren’s previous maneuvers. She had previously urged Donald Trump to disclose his crypto income for the period between January 1 and July 15, 2026.
According to disclosure documents dated June 30, Trump earned approximately $1.4 billion from digital asset holdings throughout 2025. Those crypto earnings flowed through his two business entities: Official Trump and the World Liberty Financial project.
Numerous Unresolved Issues
The hurdles to passing this bill go beyond a single party’s rejection. Passing the CLARITY Act requires at least 60 votes to clear the Senate. This threshold is difficult to reach as lawmakers remain divided on several contentious points. Key issues fueling intense debate include Trump’s alleged conflicts of interest, rules for illicit finance activities, and the oversight model for DeFi platforms. Additionally, issues surrounding stablecoin yields and the scope of the CFTC’s authority have yet to find common ground among the factions.
This stalemate contradicts the hopes of Senate Banking Committee Chairman Tim Scott. He had previously urged the U.S. Senate to hold an initial vote on the bill before the congressional recess in August. That deadline has now officially passed without any final result.
