Australia Ends Crypto Tolerance Era - Criminal Penalties and 10% Turnover Fines Take Effect October 1

The grace period for crypto firms in Australia has officially come to an end. Starting October 1, 2026, crypto businesses that have not applied for an Australian Financial Services (AFS) licence will be operating in violation of financial laws. The Australian Securities and Investments Commission (ASIC) is ending its “no action” position that has sheltered the industry during the regulatory transition.

The tolerance position expires effective September 30, 2026. This policy was never an official licence, but merely an assurance that ASIC would not pursue legal enforcement against firms adapting to the new rules. Once that protection is lifted, non-compliant entities face severe penalties: fines reaching up to 10% of annual corporate turnover, alongside the threat of civil and criminal prosecution.

ASIC’s enforcement stems from its updated Information Sheet 225 guidance issued in October 2025. Since the guidance was released, the regulator has logged more than 45 new licence applications. However, ASIC has chosen not to disclose the identities of the dozens of companies currently seeking approval.

Three-Month Extension Concludes

The enforcement deadline had already slipped from its original timetable. ASIC initially set a cutoff date of June 2026. However, pushback from industry participants seeking more transition time forced the regulator to grant a three-month extension through the end of September.

The regulator’s decision not to extend relief further follows a landmark ruling by Australia’s High Court in June 2026. The court ruled unanimously that Block Earner’s fixed-yield crypto product was required to hold a financial licence. The Block Earner verdict established a clear precedent delineating ordinary crypto offerings from investment products subject to traditional securities law.

New Regulatory Framework to Follow in April 2027

The revocation of relief marks only the initial phase of a comprehensive overhaul of Australia’s crypto laws. Parliament passed the Corporations Amendment (Digital Assets Framework) Act 2026 on April 1. This new legislation, specifically establishing a licensing regime for digital asset platforms and tokenized custody providers, will come into full effect on April 9, 2027.

The coming year will serve as a compliance test for crypto businesses serving Australian residents. Companies must operate under the existing financial services licensing regime while preparing for next year’s dedicated digital asset framework.

For users, the regulatory tightening signals the end of crypto apps operating in legal grey areas. Companies are now forced to make a choice: secure formal licensing or exit the Australian market entirely. Reported by crypto.news.
