Wall Street Prepares Lawsuit, White House Pressures - The Real Reason the SEC’s Crypto Meeting Was Canceled

A Securities and Exchange Commission (SEC) meeting scheduled to formulate the “Regulation Crypto Assets” crypto fundraising framework was abruptly canceled, just three days after it was officially announced to the public. The agency postponed the crucial agenda citing unexpected scheduling issues, without providing any additional details to market participants.

Behind the scenes, however, the delay was driven by threats of legal opposition from Wall Street and direct intervention from the presidency.

According to industry sources, the Securities Industry and Financial Markets Association (SIFMA) - an association representing Wall Street investment banks and brokers - discussed the possibility of taking legal action. SIFMA is preparing to file a lawsuit if the SEC dares to grant special exemptions or concessions to crypto firms that exceed its statutory authority limits.

This legal move targets the SEC’s plans to consider granting innovation exemptions for crypto firms. The exemptions are designed to give crypto entities leeway in trading tokenized securities assets, a plan that has drawn pushback from traditional market players.

Held Hostage by Clarity Act Negotiations

Pressure to delay the meeting also came from the White House. The administration asked the SEC to hold their agenda due to concerns that the emergence of the draft Regulation Crypto Assets would complicate Clarity Act negotiations ahead of a Senate vote on September 15.

The Clarity Act itself has not yet been finalized. Policymakers are still debating protection clauses for the DeFi sector and software developers, the division of authority for the Senate Agriculture Committee, and ethics rules for government officials.

These mutual gridlocks are weighing on market sentiment. Prediction market sources note that the probability of the Clarity Act’s passage has plunged to 10-20%, a sharp drop from an earlier estimate of 75%.

Meetings Shift to the White House

As the SEC meeting was canceled, high-level lobbying shifted location on Wednesday this week. SEC Chairman Paul Atkins and CFTC Chairman Michael Selig are scheduled to attend a special event at the White House alongside crypto executives. Donald Trump is also expected to deliver remarks at the gathering.

The event brings together top executives from the digital asset industry and traditional exchanges. Coinbase CEO Brian Armstrong, Ripple CEO Brad Garlinghouse, Gemini founders Tyler and Cameron Winklevoss, and Kraken CEO Arjun Sethi are on the guest list. Additionally, investor Chris Dixon of a16z, Chainlink CEO Sergey Nazarov, and Nasdaq CEO Adena Friedman are also attending.

The threat from SIFMA carries the message that legacy capital market players will not stand idly by. Crypto regulation must now contend with a wall of investment bankers who refuse to see new players get a shortcut.
