Australia Set to Cap Crypto Derivative Leverage - Brokers to Cover Losses Exceeding Balances

Australia’s securities regulator (ASIC) has proposed expanding contract for difference (CFD) regulations to digital asset-settled contracts. The policy covers transactions settled via digital asset transfers, including contracts that track non-crypto assets. If approved, brokers will no longer be free to offer high leverage to retail investors when trading with digital assets.

This new scope aligns the treatment of conventional cash transactions with crypto transfers. By adding contracts settled via digital asset transfers, ASIC aims to close regulatory gaps between the two instruments. The regulator’s primary objective is not only to curb leverage, but also to ensure capital protections when trading positions incur losses.

Three Key Rules in Effect Since 2021

CFD regulations in Australia have been in place since 2021 for conventional derivative instruments. The framework includes three protective pillars: establishing maximum leverage limits, requiring brokers to automatically close out trading positions when account balances fall below a certain level, and negative balance protection.

Negative balance protection is the most critical point for retail investors. Under this rule, a trader’s losses are capped strictly at the funds deposited in their CFD account. Brokers are prohibited from demanding additional deposits if the market swings wildly beyond the client’s remaining balance - a safeguard that has often been absent in crypto derivative contracts.

Which Contracts Are Still Exempt?

ASIC is not including all derivative instruments in this tightening. Crypto futures CFDs and option contracts with fixed expiry dates will remain exempt from the CFD rules. This exemption leaves room for structured products that already have a defined expiration timeline from the outset of the contract.

The public consultation period is open until Nov. 9, 2026, to gather feedback from industry participants and the public. That input will be considered by ASIC before finalizing the rules at the national level.

September Deadline and 2027 Licensing Framework

Beyond the CFD proposal, Australia passed legislation in April 2026 that brings crypto exchanges and tokenized asset custody platforms into the financial services licensing framework. That comprehensive regulatory regime is scheduled to take effect on April 9, 2027.

Ahead of the 2027 rollout, ASIC has set an earlier deadline for operating entities. Crypto firms relying on temporary enforcement relief are required to apply for a financial services license or seek regulatory adjustments before Sept. 30.

For retail traders in Australia, the room for speculating with high-leverage borrowing is shrinking. Preparing for leverage caps and automatic position close-outs will be a necessary adjustment before the new licensing regime comes into full effect.
