Federal Crypto Bill at Risk on September 15 - Republicans Hold 53 Seats as Democrats Demand Trump Family Divestment

The fate of the Clarity Act will be decided in a Senate procedural vote on September 15, 2026. Designed to divide digital asset oversight jurisdiction between the SEC and CFTC, the measure is intended to become the first federal crypto framework in the United States. However, the legislation is stalled by a 60-vote threshold required to advance. Republicans currently hold only 53 seats, and being seven votes short forces them to seek Democratic support right in the middle of a heated debate over ethics rules.

Several Republican senators have warned that the legislation could fail due to the ethics dispute and complications in other sections of the bill. Senator Mike Rounds stated that the situation heading into the vote does not look good right now. His colleague, Senator Thom Tillis, emphasized that the bill is bound to fail if the White House does not actively work to close loopholes in the ethics language.

Trump Family Business Becomes Stumbling Block

The dispute centers on one key question: whether senior government officials should be allowed to promote or profit from digital assets while in office. Democrats are demanding an explicit ban - a rule directly targeting the Trump family’s crypto ventures. They specifically cited the World Liberty Financial project and the official TRUMP coin as primary concerns.

The White House responded by claiming that Trump remains committed to passing the bill and has accepted broad ethics provisions. Democrats pushed back immediately, arguing that the administration’s proposed language is not strong enough to close loopholes surrounding businesses tied to the president’s relatives. Watchdog group Public Citizen previously urged that the president and his family be required to divest from crypto ventures.

Republicans Themselves Are Not Fully Unified

Senator Cynthia Lummis of Wyoming blamed Democrats for the ongoing Senate gridlock. Lummis asserted that if the bill fails, the reason will not be ethics, but rather because Democrats refuse to get on board.

Full support even from within Republican ranks remains far from guaranteed. Several Republican senators are reportedly still raising objections over stablecoin yield rules and banking protection provisions within the draft.

The September 15 vote will determine whether this landmark legislation can advance, or if the industry will once again have to wait for long-delayed jurisdictional clarity. Reported by crypto.news.
