Former US Defense Secretary Calls CLARITY Act a Weapon Against China - But Senate Passing Chance Only 17%

Former United States Secretary of Defense Mark Esper wrote an op-ed in the Financial Times newspaper on Saturday, calling the CLARITY Act a national security instrument rather than just a financial services regulation. Esper, who also serves as a member of the Coinbase Global Advisory Council, highlighted threats from rival nations. According to him, Beijing is currently investing in state-directed payment systems, a move designed to evade United States oversight and erode the central role of the US dollar on the global stage.

Esper’s focus was not only on China. He stated that the CLARITY Act would provide Washington with better tools to close crypto loopholes often exploited by North Korean hacking actors, such as the Lazarus Group. This regulation expands the US Treasury Department’s special measures sanction authority under Section 311 of the USA Patriot Act. Esper labeled this authority as one of the sharpest weapons available to counter bad actors.

Opposition Before Recess

Despite support from the former high-ranking defense official, the bill’s path in parliament remains bumpy. Senate Majority Leader John Thune has filed a cloture motion to bring the CLARITY Act to the Senate floor in September. However, Democrats are reportedly strongly opposing a vote before the August recess begins. Thune conveyed this deadlock directly, saying that Democrats insist on rejecting a vote on the bill.

The cloture vote is finally scheduled for September 15. The threshold is high: requiring 60 supportive votes for the regulation to move forward. According to various analysts pointing to prediction markets, the CLARITY Act’s current chance of passing is only around 17%. This pessimistic sentiment also receives additional context from dynamics on the ground, where the BIP-110 proposal is confirmed dead with a “2-block chain” after only gathering 2.5% support from miners.

Mid-September Deadline

With a 17% chance, the crypto lobby group has until mid-September to secure the remaining required votes. Their strategy now rests on negotiations around ethics rules, yield or stablecoin yield provisions, and protection clauses for developers in a separate regulation, the BRCA.

For industry players, September will be a test of how far they can find room for compromise with Washington policymakers, especially when national security matters and partisan political interests clash.
