SBF Takes 25-Year Sentence to US Supreme Court - Claims Customer Funds Intact Despite 1% Odds

Sam Bankman-Fried is taking his legal battle to the US Supreme Court. The FTX founder has officially filed a petition seeking to overturn his 2023 fraud conviction, which led to a 25-year prison sentence. As reported by The New York Times, the petition represents his latest challenge within the federal justice system.

The centerpiece of SBF’s defense rests on the calculation of customer losses. His legal team contends that the trial court erred by barring him from presenting financial arguments during the initial trial. They maintain that no FTX customers suffered actual losses, arguing that the crypto exchange always held sufficient assets to repay all customer deposits along with interest.

Beyond contesting the length of his prison term, the petition challenges the $11 billion asset forfeiture order. His attorneys characterized the financial penalty as a “crushing fine,” arguing that the magnitude violates the Eighth Amendment of the US Constitution, which prohibits excessive fines.

The move to the nation’s highest court comes shortly after SBF withdrew his motion for a new trial in early 2026. He has exhausted standard appeal avenues after a three-judge panel on the 2nd US Circuit Court of Appeals upheld his guilty verdict and 25-year sentence on June 12.

The collapse of FTX, once valued at $32 billion, began in November 2022 when it was revealed that customer deposits were funneled to plug losses at Alameda Research. SBF was subsequently arrested in the Bahamas in December 2022 and convicted on seven counts of fraud and conspiracy.

Efforts to pursue political avenues have also stalled. SBF was previously the second-largest donor to the Democratic Party during the 2021-2022 election cycle behind George Soros, contributing nearly $40 million according to OpenSecrets data. However, that history of political giving has failed to provide a viable path forward.

His petition for a presidential pardon submitted to Trump in June remains unresolved. Trump stated in January that he would not consider a pardon for SBF. His position weakened further after the US Senate voted in July to unanimously reject any clemency or pardon requests on his behalf.

What Remains Unknown

As of now, there has been no official indication from the US Supreme Court regarding whether it will agree to hear SBF’s case. The highest judicial body retains complete discretion over the cases it selects for review each term.

Judicial statistics highlight a steep uphill battle. The US Supreme Court historically accepts only about 1 percent of all petitions submitted each year. With his conviction affirmed at the appellate level and explicit political opposition from the Senate, SBF’s petition faces exceptionally slim odds.
