US Regulators Miss GENIUS Act Rulemaking Deadline - But January 2027 Effective Date Remains Binding

United States financial regulators officially missed the July 18, 2026 deadline. This was the target date set to finalize all implementing regulations for the GENIUS Act, the stablecoin legislation signed into law by Donald Trump exactly one year ago.

Failing to meet this deadline does not mean its implementation is also delayed.

Multiple Proposals, None Finalized

The primary issue currently is the stalled approval process across various government agencies. The Office of the Comptroller of the Currency (OCC) had taken an initial step by releasing a major proposed rule in February 2026. This document governs vital aspects of stablecoin issuer operations, ranging from reserve assets, redemption mechanisms, base capital, liquidity requirements, custody guidelines, to risk management standards. However, as the primary deadline passed, this comprehensive draft had yet to be enacted into a final rule.

A similar situation unfolded across other supervisory agencies. The Federal Deposit Insurance Corporation (FDIC) only released its framework in April 2026, specifically for stablecoin issuers operating under FDIC oversight. This draft document also remains incomplete. Meanwhile, institutions like the National Credit Union Administration (NCUA) remained stalled in the consultation phase, even as the deadline approached.

Technical matters concerning know-your-customer (KYC) and anti-money laundering (AML) compliance have taken even longer. The public comment period for customer identification rules for stablecoin issuers was extended beyond the July 18 deadline. Elsewhere, the Treasury Department released standalone AML compliance rules and sanctions guidance in April, coinciding with the FDIC once again issuing separate proposals for similar matters.

Seeing the multitude of overlapping agency drafts, major banking groups had previously voiced demands to regulators. They urged all institutions to coordinate these various GENIUS Act derivative proposals before finalizing them, to prevent legal loopholes or conflicting regulations down the road.

Effective Date Remains Binding on the Industry

The missed rulemaking deadline does not automatically postpone the GENIUS Act’s effective date in practice. The law remains scheduled to become binding on stablecoin industry participants on January 18, 2027. This means that exactly six months remain since the July deadline passed.

This situation forces stablecoin issuers to begin preparing their federal compliance framework systems immediately. Their operational burden has undeniably increased, as the detailed requirements across various current proposals could still change at any time before official versions are finalized.

The impact of these rulemaking delays has also trickled down to the state level. New York State is currently attempting to align its local stablecoin regulatory framework with the federal system as an initial preparation step toward GENIUS Act certification. Unfortunately, this initiative is also on hold because the state certification framework proposed by the Treasury in April has yet to take its final form.

Issuers are now left preparing in the dark. They must rebuild compliance systems for legislation that will certainly take effect in January, without knowing the exact details of the ground rules. Sourced from crypto.news.
