US Senate Advances Crypto Bill to September 15 - But 6 Key Votes Held up by Trump’s Businesses

The initial step to shift regulatory control of the cryptocurrency industry in the United States has finally been set. Senate Majority Leader John Thune officially filed a motion to end debate, or cloture, for the CLARITY Act on Saturday, August 8, 2026. This political move secures the schedule for the first procedural vote, which is set to take place on September 15 at 2:15 p.m. Eastern Time.

The news quickly drew attention. Crypto media account @Cointelegraph on X reacted to Thune’s move, calling it a major development. The tweet, which gathered 565 likes and 49 retweets, highlighted the bill’s advancement to the voting stage.

Next month’s vote is not the final decision on passage. The agenda is strictly a cloture vote on a motion to proceed, an initial procedural step that must be cleared before the bill can reach the Senate floor for debate. The CLARITY Act, designated H.R. 3633, is designed as a framework for the U.S. crypto market structure. The bill would draw jurisdictional boundaries between the SEC and the CFTC. If passed, the majority of the crypto industry would be removed from SEC oversight and moved under the control of the CFTC.

The Elusive 60-Vote Threshold

The hurdle for supporters lies in the vote count on the chamber floor. The cloture procedure requires a minimum of 60 votes to pass. Republicans are still about six votes short of support from the Democratic side. Since the draft cleared the Senate Banking Committee in May, its progress has slowed. To date, only two Democrats have declared their support.

This withholding of support is rooted in several thorny issues. Some lawmakers still raise concerns about loopholes in illicit finance prevention and law enforcement. In addition, intense debate continues to focus on stablecoin yield provisions. Without agreement on these issues, reaching the 60-vote threshold remains impossible.

Presidential Divestment Requirement

The most prominent obstacle comes from a bipartisan amendment addressing public official ethics. There is a strong push to include rules requiring President Trump to divest all of his holdings in various crypto businesses. Negotiations over these divestment terms remain contentious, and the White House has not yet clarified its position.

The mid-September vote schedule is viewed as the last realistic opportunity this year. If it successfully passes the Senate, the document cannot be signed into law immediately. The CLARITY Act must still return to the House of Representatives for a revote before reaching Trump’s desk. In the months that follow, politicians’ attention will be entirely consumed by midterm election campaigns, leaving the fate of crypto regulation in limbo.
